The importance of a representative in Switzerland for foreign companies
Article. 12a of the proposed new law on data protection under discussion before the Swiss Parliament provides for the need for controllers based abroad to appoint a representative in Switzerland if the processing:
a. is linked to an offer of goods or services in Switzerland or aimed at observing the behavior of such persons;
b. has the character of large-scale processing;
c. has the character of periodic processing;
d. involves a high risk for the personality of said persons.
